storing and accessing data on Users\u2019 Devices<\/strong> used by Users of the Service for the purpose of providing electronic services by the Administrator, as well as <strong>the rules for collecting and processing Users\u2019 personal data<\/strong>, which have been provided by them personally and voluntarily via tools available in the Service.<\/p><p><br><\/p>\n<h2>\u00a71 Definitions<\/h2>\n<ul>\n<li>\n<p class=\"translation-block\"><strong>Service<\/strong> \u2013 the website \u201cgarbiczbarns.pl\u201d operating at https:\/\/garbiczbarns.pl\/<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>External Service<\/strong> \u2013 websites of partners, service providers, or service recipients cooperating with the Administrator<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Service \/ Data Administrator<\/strong> \u2013 the Administrator of the Service and the Data Administrator (hereinafter referred to as the Administrator) is Paulina Ziomko, Garbicz 32b, 66-235 Torzym, providing electronic services via the Service<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>User<\/strong> \u2013 a natural person for whom the Administrator provides electronic services via the Service.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Device<\/strong> \u2013 an electronic device together with software through which the User accesses the Service.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Cookies<\/strong> \u2013 text data collected in the form of files placed on the User\u2019s Device.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>GDPR<\/strong>\u00a0\u2013 Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (GDPR)<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>GDPR<\/strong> \u2013 Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation).<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Processing<\/strong> \u2013 means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Restriction of processing<\/strong> \u2013 means the marking of stored personal data with the aim of limiting their processing in the future.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Profiling<\/strong> \u2013 means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that person\u2019s work performance, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Consent<\/strong> \u2013 consent of the data subject means any freely given, specific, informed, and unambiguous indication of the data subject\u2019s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Personal data breach<\/strong> \u2013 means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Pseudonymization<\/strong> \u2013 means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Anonymization<\/strong> \u2013 anonymization of data is an irreversible process of operations on data that destroys \/ overwrites \u201cpersonal data,\u201d making it impossible to identify or link a given record to a specific user or natural person.<\/p>\n<\/li>\n<\/ul>\n<h2>\u00a72 Data Protection Officer<\/h2>\n<p>Pursuant to Art. 37 GDPR, the Administrator has not appointed a Data Protection Officer.<\/p>\n<p>In matters concerning data processing, including personal data, please contact the Administrator directly.<\/p>\n<h2>\u00a73 Types of Cookies<\/h2>\n<ul>\n<li>\n<p class=\"translation-block\"><strong>Internal cookies<\/strong> \u2013 files placed and read from the User\u2019s Device by the Service\u2019s IT system.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>External cookies<\/strong> \u2013 files placed and read from the User\u2019s Device by the IT systems of External Services. Scripts of External Services that may place Cookies on the User\u2019s Devices have been intentionally placed in the Service via scripts and services provided and installed in the Service.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Session cookies<\/strong> \u2013 files placed and read from the User\u2019s Device by the Service during a single session of a given Device. After the session ends, the files are removed from the User\u2019s Device.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Persistent cookies<\/strong> \u2013 files placed and read from the User\u2019s Device by the Service until they are manually deleted. The files are not deleted automatically after the Device session ends unless the User\u2019s Device configuration is set to delete Cookies after the Device session ends.<\/p>\n<\/li>\n<\/ul>\n<h2>\u00a74 Data storage security<\/h2>\n<ul>\n<li>\n<p class=\"translation-block\"><strong>Mechanisms for storing and reading Cookies<\/strong> \u2013 mechanisms for storing, reading, and exchanging data between Cookies saved on the User\u2019s Device and the Service are implemented through built-in mechanisms of web browsers and do not allow the downloading of other data from the User\u2019s Device or data from other websites visited by the User, including personal data or confidential information. The transfer of viruses, trojans, and other worms to the User\u2019s Device is also practically impossible.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Internal cookies<\/strong> \u2013 cookies used by the Administrator are safe for Users\u2019 Devices and do not contain scripts, content, or information that could threaten the security of personal data or the security of the Device used by the User.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>External cookies<\/strong> \u2013 the Administrator makes every possible effort to verify and select service partners in terms of User security. The Administrator selects well-known, large partners with global public trust. However, the Administrator does not have full control over the content of Cookies originating from external partners. The Administrator is not responsible, to the extent permitted by law, for the security of Cookies, their content, and their licensed use by scripts installed in the Service originating from External Services. However, it should be noted that ensuring the security of this data depends on both parties, including the User\u2019s actions. The Administrator is not responsible for interception of this data, impersonation of the User\u2019s session, or deletion of data as a result of conscious or unconscious actions of the User, viruses, trojans, or other spyware with which the User\u2019s Device may be or may have been infected. Users, in order to protect themselves against these threats, should follow the recommendations for safe internet use.<\/p>\n<\/li>\n<li>\n<p class=\"translation-block\"><strong>Storage of personal data<\/strong> \u2013 The Administrator ensures that every effort is made to keep the personal data voluntarily provided by Users secure, that access to such data is limited and carried out in accordance with its intended purpose and the objectives of processing. The Administrator also ensures that every effort is made to protect the data held against loss by applying appropriate physical and organizational safeguards.<\/p>\n<\/li>\n<\/ul>\n<h2>\u00a75 Purposes for which Cookies are used<\/h2>\n<ul id=\"cele\">\n<li>Improving and facilitating access to the Service<\/li>\n<li>Personalization of the Service for Users<\/li>\n<li>Conducting statistics (users, number of visits, types of devices, connection, etc.)<\/li>\n<li>Providing social services<\/li>\n<\/ul>\n<h2>\u00a76 Purposes of processing personal data<\/h2>\n<p>Personal data voluntarily provided by Users are processed for one of the following purposes:<\/p>\n<ul>\n<li>Provision of electronic services:<\/li>\n<li>Communication between the Administrator and Users regarding the Service and data protection<\/li>\n<li>Ensuring the legally justified interests of the Administrator<\/li>\n<\/ul>\n<p>Data about Users collected anonymously and automatically are processed for one of the following purposes:<\/p>\n<ul>\n<li>Conducting statistics<\/li>\n<li>Ensuring the legally justified interests of the Administrator<\/li>\n<\/ul>\n<h2>\u00a77 Cookies of External Services<\/h2>\n<p id=\"zewinfo\">The Administrator uses JavaScript scripts and web components of partners in the Service who may place their own cookies on the User\u2019s Device. Remember that in your browser settings you can decide yourself which cookies may be used by individual websites. These entities may change their terms of service, privacy policies, data processing purposes, and methods of using cookies at any time.<\/p>\n<h2>\u00a78 Types of collected data<\/h2>\n<p>The Service collects data about Users. Some data are collected automatically and anonymously, and some data are personal data voluntarily provided by Users when registering for specific services offered by the Service.<\/p>\n<p><strong>Anonymous data collected automatically:<\/strong><\/p>\n<ul>\n<li>IP address<\/li>\n<li>Browser type<\/li>\n<li>Screen resolution<\/li>\n<li>Approximate location<\/li>\n<li>Visited subpages of the Service<\/li>\n<li>Time spent on a given subpage<\/li>\n<li>Operating system type<\/li>\n<li>Address of the previous subpage<\/li>\n<li>Referring website address<\/li>\n<li>Browser language<\/li>\n<li>Internet connection speed<\/li>\n<li>Internet service provider<\/li>\n<\/ul>\n<p><strong>Data collected during registration:<\/strong><\/p>\n<ul>\n<li>Email address<\/li>\n<\/ul>\n<p><strong>Data collected when subscribing to the Newsletter service<\/strong><\/p>\n<ul>\n<li>Email address<\/li>\n<\/ul>\n<p>Some data (without identifying data) may be stored in Cookies. Some data (without identifying data) may be transferred to a statistical service provider.<\/p>\n<h2>\u00a79 Access to personal data by third parties<\/h2>\n<p>As a rule, the only recipient of personal data provided by Users is the Administrator. Data collected as part of provided services are not transferred or resold to third parties.<\/p>\n<p>Access to data (most often on the basis of a Data Processing Agreement) may be granted to entities responsible for maintaining the infrastructure and services necessary to operate the Service, such as:<\/p>\n<ul>\n<li>Hosting companies providing hosting or related services for the Administrator<\/li>\n<\/ul>\n<p><strong>Entrusting personal data processing \u2013 Hosting, VPS, or Dedicated Server services<\/strong><\/p>\n<p>To operate the Service, the Administrator uses the services of an external hosting, VPS, or Dedicated Server provider. All data collected and processed in the Service are stored and processed in the service provider\u2019s infrastructure located in Poland. There is a possibility of access to data as a result of maintenance work carried out by the service provider\u2019s personnel. Access to this data is regulated by an agreement concluded between the Administrator and the Service Provider.<\/p>\n<h2>\u00a710 Method of processing personal data<\/h2>\n<p><strong>Personal data voluntarily provided by Users:<\/strong><\/p>\n<ul>\n<li>Personal data will not be transferred outside the European Union unless they have been published as a result of an individual action by the User (e.g., posting a comment or entry), which will make the data available to any person visiting the Service.<\/li>\n<li>Personal data will not be used for automated decision-making (profiling).<\/li>\n<li>Personal data will not be resold to third parties.<\/li>\n<\/ul>\n<p><strong>Anonymous data (without personal data) collected automatically:<\/strong><\/p>\n<ul>\n<li>Anonymous data (without personal data) will be transferred outside the European Union.<\/li>\n<li>Anonymous data (without personal data) will not be used for automated decision-making (profiling).<\/li>\n<li>Anonymous data (without personal data) will not be resold to third parties.<\/li>\n<\/ul>\n<h2>\u00a711 Legal basis for processing personal data<\/h2>\n<p>The Service collects and processes Users\u2019 data based on:<\/p>\n<ul>\n<li>Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (GDPR)\n<ul>\n<li>art. 6 sec. 1 lit. a<br><small>the data subject has given consent to the processing of his or her personal data for one or more specific purposes<\/small><\/li>\n<li>art. 6 sec. 1 lit. b<br><small>processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract<\/small><\/li>\n<li>art. 6 sec. 1 lit. f<br><small>processing is necessary for legally justified purposes executed by administrator or a third party<\/small><\/li>\n<\/ul>\n<\/li>\n<li>Act of 10 May 2018 on the protection of personal data (Journal of Laws 2018 item 1000)<\/li>\n<li>Act of 16 July 2004 \u2013 Telecommunications Law (Journal of Laws 2004 No. 171 item 1800)<\/li>\n<li>Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 1994 No. 24 item 83)<\/li>\n<\/ul>\n<h2>\u00a712 Period of processing personal data<\/h2>\n<p><strong>Personal data voluntarily provided by Users:<\/strong><\/p>\n<p>As a rule, the indicated personal data are stored only for the duration of the provision of the Service within the Service by the Administrator. They are deleted or anonymized within 30 days from the moment of termination of services (e.g., deletion of a registered user account, unsubscribing from the Newsletter, etc.).<\/p>\n<p>An exception is a situation that requires securing legally justified purposes of further processing of these data by the Administrator. In such a case, the Administrator will store the indicated data from the time of the User\u2019s request for their deletion, no longer than 3 years in the event of a violation or suspicion of violation of the Service regulations by the User.<\/p>\n<p><strong>Anonymous data (without personal data) collected automatically:<\/strong><\/p>\n<p>Anonymous statistical data, not constituting personal data, are stored by the Administrator for the purpose of conducting Service statistics for an indefinite period.<\/p>\n<h2>\u00a713 Users\u2019 rights related to the processing of personal data<\/h2>\n<p>The Service collects and processes Users\u2019 data based on:<\/p>\n<ul>\n<li>\n<p><strong>Right of access to personal data<\/strong><br>Users have the right to obtain access to their personal data, exercised upon request submitted to the Administrator.<\/p>\n<\/li>\n<li>\n<p><strong>Right to rectification of personal data<\/strong><br>Users have the right to request the Administrator to immediately rectify inaccurate personal data and\/or complete incomplete personal data, exercised upon request submitted to the Administrator.<\/p>\n<\/li>\n<li>\n<p><strong>Right to erasure of personal data<\/strong><br>Users have the right to request the Administrator to immediately delete personal data, exercised upon request submitted to the Administrator. In the case of user accounts, deletion consists of anonymization of data enabling identification of the User.
